Xarelto Lawsuit Update: Xarelto Settlements May Take Place in 2016

BloodThinnerHelp.com reports today on the new timeline of estimated Xarelto settlements.  The Xarelto lawsuits have been in the process for more than a year now and progress is starting to be made.  

Xarelto Lawsuit Timeline:

The first phase of the Xarelto lawsuits was the filing of Xarelto complaints in various state and federal jurisdictions around the country.  These complaints have been filed by various victims around the country who allege that Xarelto caused them harm in some way.  The complaints outline the legal basis for a Xarelto lawsuit and identify the damage, pain, and suffering the plaintiff endured. 

When a mass tort has multiple filings, either the plaintiff or the defense can request that the court consolidate the claims.  In December 2014 all of the federally filed Xarelto complaints were transferred into a multidistrict litigation, or an MDL, in the Eastern District of Louisiana in New Orleans under presiding District Judge Eldon Fallon.  Consolidating cases into an MDL expedite cases and saves judicial resources.  An MDL also allows lawyers from both sides to focus more on the cases and the discovery process before the initial trials and settlement talks.  This entire process usually takes about a full year. 

Currently, there are about 1,200 cases filed in the Xarelto MDL and based on the number of prescriptions issued and the adverse event rate, the number of lawsuits filed is expected to continue to rise as litigation moves forward.  

We estimate that settlement negotiations will begin to take place at the earliest in 2016.  If the defendants decide to settle these lawsuits, they may do so via a global or inventory settlement.   In a group of lawsuits regarding a blood thinner similar to Xarelto, Pradaxa, the manufacturers of the drug settled 4,000 cases for $650 million.  If no Xarelto settlement is reached in 2016, the trials will continue to be scheduled.

Xarelto's Dangerous Anticoagulant Effects:

These Xarelto cases are being brought to court because the plaintiffs allege that Xarelto was the cause of their serious adverse events such as uncontrollable internal bleeding which lead to severe injuries or death.  Xarelto is a part of a new class of blood thinners, Xa inhibitors, which block thrombin in the blood, the chemical in the blood that allows the blood to clot.  In the event of an internal bleeding injury, there is no antidote for Xarelto's effects, so if a patient is internally bleeding, there is no way to stop the bleeding.  Most of the Xarelto lawsuits allege that the drug's manufacturers were aware of these additional risks associated ith Xarelto and failed to adequately warn patients and doctors.
